Barton Gilman LLP is proud to announce that our client NYU Langone Hospitals (“NYULH”) prevailed on all federal claims in a summary judgment motion in a hotly contested suit by a former health care professional who alleged discrimination under the federal Americans with Disabilities Act (“ADA”) and retaliation under the Family Medical Leave Act (“FMLA”). In a detailed opinion, Chief U.S. District Judge Margo Brodie of the U.S. District Court for the Eastern District of New York upheld NYULH’s termination of the plaintiff’s employment and dismissed the plaintiff’s federal law claims, declining to exercise supplemental jurisdiction over the state law claims. See Ricciardo v. NYU Langone Hospitals. Firm Partner Steven Gerber, who is admitted to practice in New York, New Jersey, Massachusetts and Georgia, led the defense team.
